What Is a Final Restraining Order?
A final restraining order (FRO) is a permanent court order issued after a judge determines that domestic violence has occurred and further protection is needed. An FRO can:
-
Prohibit the accused from contacting the victim
-
Grant temporary custody of children
-
Require the accused to move out of a shared home
-
Ban firearm possession
-
Affect future court cases, employment, and immigration
Unlike temporary restraining orders, final restraining orders in New Jersey do not expire.
What Happens at a Final Restraining Order Hearing?
FRO hearings in Ocean County are typically scheduled within 10 days of a temporary restraining order being granted. They take place in Family Court at the Ocean County Superior Court in Toms River.
1. Both Parties Must Appear
Both the person requesting the restraining order (plaintiff) and the person accused (defendant) must attend. If either party fails to show up, the case may move forward without them or be dismissed.
2. The Hearing Is Like a Trial
Each side can:
-
Testify under oath
-
Present evidence (texts, photos, police reports, etc.)
-
Call witnesses
Because this is a formal hearing, it’s critical to come prepared. Both parties should strongly consider having an attorney represent them.
3. The Judge Makes a Final Decision
Under Silver v. Silver, New Jersey courts apply a two-part test before entering a final restraining order:
-
An act of domestic violence occurred (such as harassment, assault, or stalking)
-
A restraining order is needed to prevent further harm
If these criteria are not met, the case is dismissed and the TRO is lifted.
How a Final Restraining Order Affects You
If granted, a final restraining order can have long-term consequences:
-
Appear on background checks
-
Limit your ability to own firearms
-
Affect child custody and visitation rights
-
Result in criminal charges if violated
These are not minor penalties, which is why representation is so important.
