Big changes coming to alimony in NJ

On September 10, 2014, Governor Christie signed bill A 845 into law. This is the most sweeping change to the law of alimony in our state in forty (40) years. Highlights of the new law include:
1. limitations on alimony awards to the years of the marriage;
2. provisions for quicker modifications based upon loss of work and wages; and
3. substantive guidance on permitting the modification or elimination of alimony in the cases of retirement of the paying spouse and/or cohabitation of the alimony recipient.
Importantly, the legislation eliminates the term “permanent alimony” and adopts the term “open durational alimony” for marriages of over (20) years, or in the case of exceptional circumstances.
